Prosecutor asks for postponement until after Supreme Court ruling in another case
U.S. District Judge Thomas Russell on Friday delayed setting a hearing date for Michael Carneal while he reviews a motion to suspend further proceedings until the U.S. Supreme Court rules in a related case.
Carneal, now 26, is the former Heath High School student who in 1997 shot and killed three classmates and wounded five others. He pleaded guilty but mentally ill and was sentenced to life without a chance of parole for 25 years.
Russell last week ruled that Carneal is entitled to a hearing to determine if mental illness prevented him from appealing his guilty plea before the time for appeal had expired.
